The Invitation to Appeal is specifically what the name implies — an invitation to you to appeal for an Australian skilled migrant visa. It will show the below information:
  • The subclass below which you are being called to apply
  • The time span within which you need to make your application of visa
  • Any further information you must include with your appeal
The last step is making and lodging your application of visa.

Process for a Sponsored Work Visa for Australia

It only works if you are a “genuine” applicant / entrepreneur and have “genuine” funds “genuinely” available!
Why do we say “genuine” so many times? It is from the Immigration Rules – Genuine Entrepreneur Test and it is the main reason for refusals in this visa category. Evidence of funds – can be arranged; evidence of English – same; evidence of being “genuine” – now it gets tricky (for you) and makes it easier for the government to refuse your application.

Our advice – be a genuine applicant! May sound obvious but this is the most important thing in the whole application! You have to be a genuine entrepreneur and genuinely intending to come to the UK to run your own business or to join an existing one. Do not use this category “just to come to the UK”, it is fairly obvious to professionals like us (and the Government officers!) when someone is trying to do so.

When we work on an Entrepreneur visa application, we look at least at one of the following (better both):

1) Does the migrant have past experience of running his/her own business? If the answer is No, maybe at least their family members do? Such as a parent or uncle’s business in their home country.
2) Does the migrant have past experience in working in the chosen business sector? Very often we see foreign students applying as Entrepreneurs, in which case they have to at least have relevant qualifications.
Here are some examples that work:
A student obtains a UK degree while on a Tier 4 visa, returns to their home country and applies for an Entrepreneur entry visa to set up a business in the sector that he studied and which is connected to his family’s work in the home country. For example, a student obtains an accountancy qualification here and has a parent who is employed as an accountant in their home country. Here most “skilled” business sectors work but generic things, like export/import of clothes or phones, tend to be less successful. A restaurant or a shop are least likely to succeed unless it is a franchise (Subway is very popular).
A variation of the above: a student applies to set up a business in the UK, which is connected to his/her UK degree. They have no family members working in that field but their family run a different business in their home country. Although there is no connection to the given business sector, the family members’ experience of running a business would be helpful to guide our client with running a business in the UK. The general logic of running a business is the same in any country, the details are different, for which a professional, such as a UK lawyer or accountant, can be hired from the £200,000 investment.
A Tier 2 migrant comes to the UK, works for 2 years in, say, IT sector, then applies for Entrepreneur visa to run a business in the same or similar field, using the business connections that he has built up during the time spent on Tier 2. Here the previous experience of running a business would not be important.
A foreign entrepreneur has been running a successful business in their home country for several years, can prove it with official tax filings (not cash business), and now wishes to set up the same kind of enterprise in the UK. This usually works well, especially if manufacturing of goods is involved (future manufacturing in the UK) but tends to work better for “skilled” or specialist industries. Again setting up a shop or buying/selling business like at home tends to be risky, although it depends on the case and the applicant. (UK Tier 1 Visa)

For all Non-EU citizens who would like to come to Austria, there are different kinds of possible work and residence permits. For highly qualified persons, two options are especially interesting if an immigration to Austria is desired: The Red-White-Red Card and the Blue Card EU.

What is the difference between the Red-White-Red Card and the Blue Card EU?

For the Red-White-Red Card, a point system is in place where applicants have to achieve a certain number. Points are given for example for the qualification/ the studies, knowledge of the German or English language, work experience and the age.
The other option is the Blue Card. Mainly two points are decisive to find out if a person is qualified for one. The applicant has to prove that he has studied for at least three years at a credited University and the monthly salary has to be at least 1,5 times the amount of the average gross income in Austria.

The required amount has been raised for 2018, in 2017 only 4.266,00 € per month were required but the amount is always adapted to the average income in Austria.

Change of requirements for the Blue Card EU:


There are certain general requirements that had to be fulfilled for both residence permits. One of them has been the confirmation of a suitable apartment in Austria for at least three months. There has been a change to this rule recently: The confirmation of an apartment is now only required for applications for a Red-White-Red Card. No such confirmation will be necessary for the application of the Blue Card EU.
As it is not easy to find something suitable and affordable for three months from abroad, this simplifies the application process for the Blue Card a lot. The card can however only be picked up at the authority after the applicant is registered in Austria – latest at this point also the applicants for a Blue Card therefore need to have a suitable accommodation. The good thing is that no specific time frame is necessary and in total, the applicants have more time for the search. Changes regarding the entry Visa: from now on, a D-Visa is necessary

Furthermore, there have been changes regarding the entry Visa:
Once a residence permit has been granted by the Austrian authorities and the applicant needs a Visa to enter Austria, the responsible Embassy will be informed immediately. The Embassy then contacts the applicant directly and gives information about the required documents for a national D-Visa.
This special D-Visa allows the applicant a one-time entry to Austria and serves specifically the purpose to collect the residence permit. As soon as the applicant has the residence permit in hand, the Visa is no longer required.
A lot of applicants already have a valid Schengen-Visa which would allow them to come to Austria. It is no longer possible however to collect the residence permit with it. In order to pick up the residence permit, the national D-Visa is required. This means that despite the fact that they still have a valid Visa, also Schengen-Visa holders have to apply for a national D-Visa as only this special Visa allows them to collect the residence permit.
As the Embassy will be notified about the positive decision for the residence permit directly from the authority in Austria, the Visa application process is usually very smooth and without problems.
Depending on the Embassy, the Visa application process can however take 2-4 weeks. This should be kept in mind while arranging the travel to Austria.

Step 3 Pass Basic Requirements

All visas, no matter which provinces or territories they are in, will have basic requirements you must pass before you can go further with your immigration.
Set work experience is normally a requirement for any economic immigration program. You must generally have around three years of work experience to apply though this does vary from program to program so make sure you know before you apply.
Please note that internships and volunteer work will generally not be counted as work experience. Some programs will require Canadian work experience.
Language ability matters. Depending on where you immigrate, your language skills in French or English can really influence your immigration chances.
You must prove that you have the ability to speak, read, write and listen in either of these languages to a sufficient degree. You can do this through the IELTS (International English Language Testing System) for English exams and TEF (Test d'evaluation) for French exams.
Just make sure you select the General Option for these exams, as it is commonly used for immigration purposes. Do not select the Academic version unless you wish to study in Canada as an international student.
A clear criminal record is a must when you apply to immigrate to Canada. You must prove this through a Police Clearance Record. Anything from a DUI to unpaid speeding tickets can cause real issues with your application.

A valid form of identification like your ID, passport, birth certificate or driver’s license;
